A Strata Title Subdivision defines the space for each lot in a building and can be used for residential unit blocks, villas, townhouses, commercial offices, industrial compounds and retirement villages.

A Strata Title Subdivision is a subdivision of land into separate lots and common property. It may be used for residential, commercial, retail and industrial schemes.

The Strata Scheme

All Strata Schemes are depicted in Strata Plans. The Strata Plan is a subdivision of a parcel of Real Property Land into separate lots and common property. The Scheme is a building or collection of buildings where the property that each individual owns is called a “lot” and the owners share ownership and responsibility for the “common property.” Strata Schemes are self-governing communities operating as a democracy, where the owners decide collectively how to best manage the property they share. Under the Strata Schemes Management Act 2015, each lot owner has the right to vote on decisions affecting the strata scheme. Equally, the owners have responsibilities, like sharing the costs for the maintenance of the common property.

The Strata Plan

The Strata Plan shows the layout of the Strata Scheme and the extent and nature of the Strata lots. The Strata Plan must be prepared to comply with current legislation including:

  • Strata Schemes Development Act 2015
  • Strata Schemes Development Regulation 2106
  • Strata Schemes Management Act 2015
  • Strata Schemes Management Regulation 2016

Strata Plans are plans subdividing land. Only a Surveyor registered with the Board (BOSSI) can prepare Strata Plans.

The Draft Strata Plan

Draft Strata Plans are prepared from architectural plans. They are prepared to assist with the “off the plan” marking of a development. They are normally annexed to contracts for sale. Draft Strata Plans are also required should development approval be sought to subdivide. They are required to accompany an application to Council for subdivision approval.

The Final Strata Plan

When the building is completed a survey is undertaken to measure the extent of the strata lots. All Strata Plans must be prepared by a Surveyor registered under the Surveying and Spatial Information Act 2002. The land to be subdivided must have the building within its boundaries. Titles for the strata lots cannot be issues until the final strata plan is registered.
